Freedom of expression and hyperlinking

In this month’s issue of IRIS 2019/2 (Legal Observations of the European Audiovisual Observatory), we have reported about the clarification by the European Court of Human Rights (ECtHR) on how to interpret and apply the liability of newsplatforms hyperlinking to defamatory external content. Holding media companies  automatically liable for defamatory content hyperlinked in their reports violates the right to freedom of expression. In certain particular circumstances howewer, the posting of a hyperlink can potentially engage the question of liability, for instance, where a journalist does not act in good faith and in accordance with the ethics of responsible journalism ((see ECtHR Appl. 11257/16 Magyar Jeti Zrt v.
